Twynity Platform — Terms of Use
These terms apply when you create an account on the Twynity platform. April 2026.
About these terms. These are the terms that govern your general use of the Twynity platform operated by 4th-IR Group AG. They apply from the moment you create an account. If, later, you choose to create a Virtual Persona ("Twyn") from your own voice and likeness, you will be asked to accept an additional set of terms and to give explicit biometric consent before that step begins. This document does not yet give us permission to process your voice or face — only to give you an account.
1.. Who we are. The Twynity platform is provided by 4th-IR Group AG, a company incorporated in Switzerland with its registered office at Alpenstrasse 16, 6300 Zug ("4th-IR", "we", "us"). You can contact us at info@4th-IR.com. For data-protection queries, contact info@4th-IR.com.
2.. Eligibility. You must be at least 18 years old and able to enter into a binding contract under the law of your country of residence. By creating an account you confirm that this is the case.
3.. Your account. You are responsible for keeping your login credentials secure and for any activity on your account. You agree to provide accurate information when you sign up, and to keep it up to date. You may close your account at any time from your account settings.
4.. What you can do with the platform at this stage. A Twynity account lets you explore the platform, review documentation, manage your profile, configure preferences, and begin the process of creating a Twyn. A Twyn is not created automatically and no biometric data is collected by us at signup. You may use the platform only for lawful purposes and in accordance with these terms.
5.. Information we process at signup. At signup we process the ordinary personal data you provide — for example your name, email address, password (stored only as a salted hash), country, and, where applicable, your employer and role. We use this information to operate your account, to communicate with you about the service, and to comply with our legal obligations. Our legal basis is performance of this contract with you (GDPR Art. 6(1)(b); Swiss FADP Art. 31). Further detail is in our Privacy Policy.
6.. No biometric data at this stage. We do not collect, process or store any biometric data — such as voice recordings, facial imagery, voiceprints or facial geometry — as part of signup. Biometric data is only collected if and when you choose to create a Twyn, and only after you have separately accepted the Twynity Twyn Creation Terms and given an explicit on-camera consent. You can use the platform indefinitely without ever providing biometric data.
7.. Acceptable use. You agree not to use the platform to: (a) break any applicable law; (b) infringe anyone else's intellectual property, privacy or other rights; (c) send unsolicited commercial messages, spam, or malware; (d) attempt to gain unauthorised access to the platform, its users, or its underlying systems; (e) scrape, reverse-engineer, or interfere with the platform; or (f) impersonate any other person or entity.
8.. Content you upload. If you upload documents, text or other content to the platform for use with your account, you keep all rights in that content. You grant 4th-IR a limited, non-exclusive licence to host, process and display that content strictly for the purpose of providing the platform to you. You are responsible for making sure you have the right to upload the content you upload.
9.. Subscription and fees. Some Twynity features are offered under a free plan and others require a paid subscription. Where you subscribe to a paid plan, the price, billing cycle, and cancellation terms shown at the point of purchase apply and form part of these terms. Taxes are charged in addition where required. You can cancel a subscription at any time; cancellation takes effect at the end of the current billing cycle.
10.. Service availability and changes. We aim to keep the platform available at all times but cannot guarantee uninterrupted service. We may update, improve, or change features, and may occasionally suspend or withdraw features on reasonable notice. Where a change has a material adverse effect on paying customers, we will give you at least 30 days' notice and a pro-rata refund option.
11.. Suspension and termination. We may suspend or terminate your account if you breach these terms, if we are legally required to, or if we reasonably believe that your account is being used to cause harm. Where reasonable, we will warn you first and give you an opportunity to remedy the breach. You may terminate at any time by closing your account.
12.. Intellectual property. The Twynity platform, its software, design, trademarks (including the Twynity name and logo) and documentation are and remain the property of 4th-IR or its licensors. Nothing in these terms transfers any of those rights to you beyond the limited right to use the platform as described here.
13.. Disclaimers. The platform is provided "as is" and "as available". To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms limits any rights you have that cannot be limited by law, including consumer rights under mandatory local law.
14.. Limitation of liability. To the extent permitted by law, 4th-IR's total liability to you arising out of or in connection with these terms is limited to the greater of (a) the fees you have paid to 4th-IR in the twelve months preceding the event giving rise to the claim, or (b) CHF 100. We are not liable for indirect or consequential loss, lost profits, lost revenue, or lost data, except where such exclusion is not permitted by law. Nothing in these terms excludes liability for fraud, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.
15.. Your data and privacy. Our processing of your personal data is governed by the Twynity Privacy Policy. Where you later choose to create a Twyn, the additional processing of your biometric data is governed by the Twynity Biometric Data Notice, and is based on your separate explicit consent.
16.. Changes to these terms. We may update these terms from time to time. Where a change is material, we will notify you by email or in-product at least 30 days before the change takes effect. Your continued use of the platform after the change takes effect means you accept the updated terms. If you do not accept them, you may close your account before they apply.
17.. Governing law and disputes. These terms are governed by the laws of Switzerland, excluding conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The courts of Zug, Switzerland have exclusive jurisdiction, except that we may bring proceedings in your country of residence where required by mandatory local consumer law. Nothing in this clause affects any non-waivable consumer right to bring a claim in your country of residence.
18.. Miscellaneous. If any part of these terms is held unenforceable, the rest remain in force. Our failure to enforce a right is not a waiver of that right. You may not transfer your account or these terms to anyone else without our consent. We may transfer our rights and obligations to a group company or a successor in connection with a corporate transaction.
